Affordable Housing as a Matter of Provincial Interest

Change to Section 2 of the Planning Act

The Strong Communities through Affordable Housing Act, 2011 amended clause 2 (j) of the Planning Act to include a specific reference to affordable housing as a matter of provincial interest, as follows: 

  • (j) the adequate provision of a full range of housing, including affordable housing (words added as a result of change shown in italics)

Why are provincial interests important?

Section 2 of the Planning Act identifies a range of provincial interests.  Decision-makers must have regard to provincial interests when making land use planning decisions to ensure that matters of importance to Ontario and Ontarians are protected, conserved or encouraged to occur.

Effective Date of Changes to Section 2

The changes to the Planning Act relating to section 2 provincial interests came into effect on May 4, 2011.
