Flowchart 1 - Notice of Open House, Public Meeting and "Complete Application"

(each notice may be given separately or in combination with one or both of the other notices)

For Consultation and public meeting for an official plan or official plan amendment (OP/A) [17(15)(a) and (b)], the municipality must provide approval authority or prescribed public bodies information and material listed in Section 2 of O.Reg 543/06 (See Appendix A) and all other supporting  information and material

The Notice of Open House or Notice of Public Meeting [17(17)] or Notice of
“complete application” [22(6.4)(a)] must be given (Notice for “complete application” follows this process with necessary modifications).

Notice must be given to:

Every landowner within 120m and by posting on the property, or the public at large by publishing in a newspaper.

Anyone that has given the Clerk or Secretary-Treasurer of a Planning Board a written request for notice of any OP/A.

The list of persons/public bodies identified in subsection 3(9) of O.Reg 543/06 (See Appendix B) (notice to the approval authority must also include a copy of the OP/A)

The Director of MMAH MSO that is responsible for the area where the subject lands are located, including a copy of the OP/A (unless the municipality has been requested not to send such notices)

Notice by Posting on the property shall include:

  1. Date/time/location of public meeting or open house
  2. Explanation of OP/A
  3. Where & when information and copy of OP/A will be available
  4. How to obtain a copy of the notice under subsection 3(15) of O.Reg 543/06

Notice shall include specific information of subsection 3(15) of O. Reg. 543/06 (See Appendix C)

Timing:

  • Open House must be held at least 7 days before public meeting. [17(18)]
  • Public meeting notice must be given at least 20 days before public meeting. [17(19)]
  • Complete application notice must be given within 15 days after affirmative notice has been given to the applicant. [22(6.4)]

Flowchart 2 - Notice of Adoption (Exempt Municipality)

Notice of Adoption for OP/A must include specific information listed in Section 4 of O.Reg 543/06 (See Appendix D) [17(23)]

Notice must be given to:

Appropriate approval authority [17(23)(a)]

Each person/public body that filed a written request with the Clerk [17(23)(b)]

Any prescribed person/public body [17(23)(c)]

The Director of MMAH MSO that is responsible for the area where the subject lands are located, including a copy of the OP/A (unless the municipality has be requested not to send such notices)

Timing:

Notice of Adoption must be given within 15 days of adoption [17(23)]

Flowchart 3 - Appeal to OMB (Exempt Municipality)

The process to Forward Material to OMB as a result of appealing the adoption of an OPA (or OP) exempt from approval [17(24)]

Material that must be forwarded must include:

The record - which must be compiled with specific information as listed in Section 6 of O.Reg 543/06 (See Appendix E)

The Notice of appeal

The Fee prescribed by the OMB

Such other information that may be required by the OMB

The record and the Notice of appeal must be forwarded to appropriate approval authority (unless requested not to forward)

The record and the Notice of appeal, the Fee prescribed by the OMB and such other information that may be required by the OMB must be forwarded to the OMB.

Timing:

The record, notice of appeal and fee must be forwarded to OMB and the record and the notice of appeal to the approval authority within 15 days from the last day of filing appeals [17(29)(b) and (c)]

Flowchart 4 - Adoption (Non-exempt Municipality)

The Record to be forwarded to approval authority once OP/A is adopted (not exempt from approval) [17(31))]

Material that must be forwarded to the appropriate approval authority must include:

The record - which must be compiled with specific information as listed in Section 7 of O.Reg 543/06 (See Appendix F)

Any fee under Section 69 or 69.1

Such other information that the approval authority considers it may need

Timing:

The record and fee must be forwarded within 15 days from adoption [17(31)]

Appendix F - Record to be forwarded to approval authority once OP/A is adopted (17(31) of Act) Section 7 of O. Reg. 543/06


Flowchart 5 - Notice of Approval Authority's Decision

Notice of Approval Authority’s Decision [17(35)] must include specific information listed in Section 8(1) of O.Reg 543/06 (See Appendix G)

Notice must be given to:

The council or planning board that adopted the plan [17(35)(a)]

Each person/public body that filed a written request to be notified of the decision  [17(35)(b)]

Each council or planning board to which the OP/A would apply [17(35)(c)]

Any prescribed person/public body [17(35)(d)]

The Director of MMAH MSO that is responsible for the area where the subject lands are located, including a copy of the OP/A (unless the municipality has be requested not to send such notices)

Flowchart 6 - Appeal to OMB of Approval Authority's Decision/Non-decision

Forward Material to OMB as a result of appealing a decision [17(36)] or failure to give notice of a decision within 180 days [17(40)]

Material that must be forwarded to the OMB must include:

The record - which must be compiled with specific information as listed in Section 9 of O.Reg 543/06 (See Appendix H)

Notice of appeal

Fee prescribed by the OMB

Such other information that may be required by the OMB

Timing:

The record, notice of appeal and fee must be forwarded within 15 days from the last day of filing appeals as a result of appealing a decision or within 15 days after an appeal was filed for a failure to give notice of a decision within 180 days [17(42)(b)]

Flowchart 7 - Notice of Refusal to Adopt OPA

Notice of Refusal to Adopt OPA must include specific information listed in Section 12 of O.Reg 543/06 (See Appendix I) [22(6.6)]

Notice must be given to: The person/public body that made the request [22(6.6)(a)]

Each person/public body that filed a written request to be notified of the refusal [22(6.6)(b)]

The appropriate approval authority [22(6.6)(c)]

Any prescribed person/public body [22(6.6)(d)]

Timing:

Notice of refusal to adopt must be given within 15 days of the day of the refusal [22(6.6)]

Flowchart 8 - Appeal to OMB on Refusal to Adopt OPA

Forward Material to OMB as a result of a 22(7) appeal [22(9)]

Notice of appeal

Fee prescribed by the OMB

Such other information that may be required by the OMB

The record and Notice of appeal must be forwarded to the appropriate approval authority (unless requested not to forward)

The record, Notice of appeal Fee prescribed by the OMB and such other information that may be required by the OMB must be forwarded to the OMB.

Timing:

The record, notice of appeal and fee must be forwarded to the OMB and the record and notice of appeal to the approval authority within 15 days after the notice is received [22(9)(b) and (c)]
