Flowchart 1 - Notice of Open House, Public Meeting, and "Complete Application"

Notice of Open House, Public Meeting, and “Complete Application”
(each notice may be given separately or in combination with one or both of the other notices)

Council shall ensure that the public is provided with sufficient information and material to understand the zoning proposal, hold a public meeting and / or open house.  [34(12)]

The Notice of Open House or Notice of Public Meeting [34(13)] or Notice of
“complete application” [34(10.7)] must be given (Notice for “complete application” follows this process with necessary modifications).

Notice must be given to:

Every landowner within 120m and by posting on the property, or the public at large by publishing in a newspaper.

Anyone that has given the Clerk or Secretary-Treasurer of a Planning Board a written request for notice of any ZBL/A.

The list of persons/public bodies identified in subsection 5(9) of O.Reg 545/06 (See Appendix A)

The Director of MMAH MSO that is responsible for the area where the subject lands are located, (only where the Director has requested such notification)

Notice by Posting on the property shall include:

1. Date/time/location of public meeting or open house
2. Explanation of ZBL/A
3. Where & when information and copy of ZBL/A will be available
4. How to obtain a copy of the notice under subsection 5(11) of O.Reg 545/06

Notice shall include specific information of subsection 5(11) of O. Reg. 545/06 (See Appendix B)

Timing:
Open House must be held at least 7 days before public meeting. [34(14)]
Public meeting notice must be given at least 20 days before public meeting. [34(14.1)]
Complete application notice must be given within 15 days after affirmative notice has been given to the applicant. [34(10.7)]

Flowchart 2 - Notice of Passing for Zoning By-law/Amendment

Notice of passing ZBL/A must include specific information listed in Section 6(9) of O.Reg 545/06 (See Appendix C) [34(18)]

Notice must be given to:

Every landowner within 120m or the public at large by publishing in a newspaper
Each person/public body that filed a written request for notice with the Clerk
The list of persons/public bodies identified in subsection 6(7) of O. Reg. 545/06 including a copy of the ZBL/A (See Appendix D)
The Director of MMAH MSO that is responsible for the area where the subject lands are located, including a copy of the ZBL/A (only where the Director has requested such notification)

Timing:
Notice of passing must be given within 15 days of passing [34(18)]

Flowchart 3 - Notice of Refusal to Amend Zoning By-law/Amendment

The notice of refusal to amend ZBL must include specific information of Section 4 of O. Reg. 545/06 (See Appendix E) [34(10.9)]

Notice must be given to:

The person/public body that made the application [34(10.9)(a)]
Each person/public body that filed a written request to be notified of a refusal [34(10.9)(b)]
Any prescribed person/public body [34(10.9)(c)]

Timing:
The notice of refusal must be given within 15 days of the day of the refusal [34(10.9)]

Appendix E - Specific information to be included in Notice of refusal to amend zoning by-law (34(10.9) of Act) Section 4 of O. Reg. 545/06

Flowchart 4 - Appeal to OMB of Zoning By-law/Amendment

To forward material to OMB as a result of:
appealing a refusal to amend the ZBL/A [34(11)],
failure to give notice of a decision within 120 days [34(11)] or,
passing a ZBL/A [34(19)]

Material that must be forwarded to the OMB must include:

The record - which must be compiled with specific information as listed in Section 7 of O.Reg 545/06 (See Appendix F)
Notice of appeal
Fee prescribed by the OMB
Such other information that may be required by the OMB

Timing:
The record, notice of appeal and fee must be forwarded within 15 days from the last day of filing appeals under 34(11.0.3) or within 15 days after an appeal under 34(19) was filed. [34(23)]

Flowchart 5 - Notice of Intention to Remove Holding Symbol

Notice of intention to pass amending by-law to remove Holding Symbol must include specific information of Section 8(7) of O.Reg 545/06 (See Appendix G) [36(4)]

Notice must be given to:

Every landowner within the area where the subject land is located or the public at large by publishing in a newspaper
Each person/public body that has given a written request for notice to the Clerk or Secretary-Treasurer of a Planning Board

Flowchart 6 - Notice of Passing Interim Control By-law

Notice of Passing an Interim control by-law or extension period must include specific information of Section 9(8) of O. Reg. 545/06 (See Appendix H) [38(3)]

Notice must be given to:

Every landowner within 120m or the public at large by publishing in a newspaper
The list of persons/public bodies identified in subsection 9(6) of O. Reg. 545/06 (See Appendix I)
The Director of MMAH MSO that is responsible for the area where the subject lands are located (only where the Director has requested such notification)

Timing:
Notice of Passing must be given within 30 days of passing [38(3)]

Flowchart 7 - Appeal to OMB of Interim Control By-law

Forward Material to OMB as a result of appealing a passing of an interim control by-law [38(4)]  (Section 38(5) indicates that Sections 34(23) to (26) apply)

Material that must be forwarded to the OMB must include:

The record - which must be compiled with specific information as listed in Section 7 of O. Reg. 545/06 (See Appendix F)
Notice of appeal
Fee prescribed by the OMB
Such other information that may be required by the OMB

Timing:
The record, notice of appeal and fee must be forwarded within 15 days from the last day of filing appeals under 38(4) [34(23)]
