BUILDING CODE COMMISSION DECISION ON B.C.C. #93-22-378

IN THE MATTER OF BUT NOT LIMITED TO: Ontario Building Code, O/Reg. 413/90, as amended

Article 9.29.2.1.

Requirement for waterproof wall finish.

COMMISSION RULING:

In favour of the Respondent.

Regarding the minimum height of waterproof finish required above the rim of a whirlpool tub on a vertical wall 6 inches from the rim, at 61 Raymar Place, Oakville, Ontario.

It is the decision of the Building Code Commission that providing only waterproofing material 4 inches above the whirlpool tub on the vertical wall does not comply with the Ontario Building Code.

REASON:

The existing waterproofing material along the vertical and horizontal does not provide sufficient waterproofing protection.
