The EBR has also applied to Planning Act regulations and instruments since April 1, 1998.

  • Instruments are any document of legal effect, such as licenses, orders, permits or directions issued under a prescribed legislation. Under the EBR, the Ministry of Municipal Affairs and Housing is required to "classify" all environmentally significant Planning Act and Building Code Act (related to septic systems) Instruments in Instrument Classification Regulations. MAH posted its Decision Notice for a Regulation to classify Planning Act instruments for the EBR under RF9E0003 and its Decision Notice for a Regulation to classify Building Code Act (relating to septic systems) instruments for the EBR under RF9E0002.

  • As of April 1998, the EBR requires MAH to place notices on the Registry for all environmentally significant Regulations, under the Planning Act and as of April 27, 2001, the EBR requires MAH to place notices on the Registry for all environmentally significant Regulations under the Building Code Act (related to septic systems).

  • Through an amendment to O. Reg 73/94, Minister's Zoning Orders (MZOs) are exempt from Notice requirements (i.e. "Proposal" and "Decision" Notices). However, an Information Notice - also referred to as an "Exception Notice" will be posted on the EBR Registry once the MZO is filed.
