BUILDING CODE COMMISSION

IN THE MATTER OF Subsection 24(1) of the Building Code Act, S.O. 1992, c. 23, as amended.

AND IN THE MATTER OF an application by Hugo Arriojas, of HOK Inc., for the resolution of a dispute with Arlene Grégoire, Director & Chief Building Official for the City of Ottawa, to determine whether the proposal to install non-breakaway sliding doors, in the means of egress from three private offices within a Group D occupancy, 465 m2, one storey building, provides sufficiency of compliance with the requirements of Sentence 9.9.6.4.(2) of Division B of the Building Code, when considering Part 3 requirements for means of egress from rooms, at 5349 Fernbank Road, City of Ottawa, Ontario.

RULING

 

1. Commission Ruling

It is the decision of the Building Code Commission that the proposal to install non-breakaway sliding doors, in the means of egress from three private offices within a Group D occupancy, 465 m2, one storey building, provides sufficiency of compliance with the requirements of Sentence 9.9.6.4.(2) of Division B of the Building Code, when considering Part 3 requirements for means of egress from rooms, at 5349 Fernbank Road, City of Ottawa, Ontario.

2. Reasons

  1. Sentence 9.9.6.4.(1) of Division B of the Building Code requires exit doors and doors in required means of egress, except doors in means of egress within dwelling units, to swing on the vertical axis. Sentence 9.9.6.4.(2) requires sliding doors installed as required doors in a means of egress to have a break away feature and shall be identified as swinging doors by means of a label or decal affixed to the door.

  2. The Commission heard that a building of the same height and occupancy, but exceeding 600 m2 in building area must conform to Part 3 of Division B of the Building Code and that within such buildings the proposed non-breakaway sliding doors are permitted within the means of egress from private offices. The Commission heard that the subject Part 9 building meets the same construction requirements as a Part 3 building of similar occupancy and building height. The Commission is of the opinion that Part 3 requirements represent a higher set of minimum requirements than the equivalent Part 9 requirements.
