For service managers who have Section 95 Federal Unilateral housing providers within their portfolios, I wish to bring to your attention, Section 157 of the Social Housing Reform Act, 2000. This section states that the service manager and housing provider may terminate the Section 95 operating agreement and replace it with all the terms and conditions of the Social Housing Reform Act, 2000. Both parties must agree to this change in writing. If such a change were to take place, Section 95 housing providers would have their revenues and operating costs benchmarked and would be bound by all provisions of the Act.
I encourage all service managers with Section 95 housing providers to review this section of the Act with their housing providers, examining the possibility of switching these providers from their Section 95 Operating Agreements to the Social Housing Reform Act, 2000.
