The purpose of this notification is to inform Service Managers of recent amendments to Ontario Regulations 368/11, 367/11 and 298/01 under the Housing Services Act, 2011 (HSA).

Through correspondence and consultations, Service Managers, housing providers and other stakeholders in the housing sector raised concerns and proposed various recommendations on all areas of housing including ways in which regulations under the Act could be enhanced to:

  • Clarify provisions to better align them with the original policy intent;
  • Increase Service Manager flexibility and reduce administrative burden; and,
  • Ensure accuracy and internal consistency.

On July 1, 2014, the following changes to Ontario Regulations 368/11, 367/11 and 298/01 will come into effect. These changes align with Service Manager and housing provider recommendations, and are consistent with our goals – to ensure that the legislative framework within which Service Managers and housing providers administer and deliver social housing is clear, accurate and effective.

Overview of regulatory changes:

  1. Amendments to Ontario Regulation 368/11 to correct housing project information (e.g., addresses, names of projects, etc.).
    Note: Regulatory changes did not result in the removal of any housing projects from Ontario Regulation 368/11.
  2. Amendments to Ontario Regulation 367/11 to change Special Needs Housing Administrators in York and Peel Region, as requested jointly by both Service Managers and housing providers.
    Note: Eight housing providers were removed as Special Needs Housing Administrators from Ontario Regulation 367/11, at the request of the Service Manager and the housing provider.
  3. Amendments to Ontario Regulation 367/11 to allow impartial review bodies to uphold the original date of a decision by the Service Manager with respect to rent-geared-to-income (RGI) eligibility.
  4. Amendments to Ontario Regulation 367/11 to only require Service Manager Consent (no Ministerial Consents) for easements.
  5. Amendments to Ontario Regulation 367/11 to align selection system rules for special needs housing with existing general rent-geared-to-income (RGI) tenant selection rules.
  6. Amendments to Ontario Regulations 367/11 and 298/01 to reformat tables to ensure they are accessible and to better comply with the Ontarians with Disabilities Act, 2001 (ODA), and the Accessibility for Ontarians with Disabilities Act, 2005 (AODA).
